ADA INTERPRETATIONS DISPUTED ON SEVERAL ISSUES IN NEW YORK
According to the November 10, 2004 issue of the Transit Access Report there are several regulatory interpretations that remain at issue following a review of federally required paratransit service in New York City.
The FTA is challenging New York City Transit over policies that
Offer only one possible pickup time within one hour of the time requested for a pickup.Require a minimum of time to elapse between an outbound trip and a return trip.Consider the period between midnight and 4 a.m. to be part of the preceding day's schedule.
Michael A. Wright, director of the FTA's Office of Civil Rights, suggests that these policies may violate provisions of the Dept. of Transportation's Americans With Disabilities Act regulations. He call for change in the policies in a letter to NYCT dated Oct. 22,2004, the same date as the final report of the FTA's NYCT paratransit review.
The Winter letter is devoid of issues relating to the capacity of "Access-A-Ride", a system that provides an estimated 10,000 ADA paratransit rides a day through eight contract carriers in New York City's five boroughs.
